These Terms of Service ("Terms") govern your purchase and use of a membership ("Membership") offered through this website (the "Site"), operated by Nic Dean ("we," "us," or "our"). By purchasing a Membership or using the Site, you agree to these Terms. Please read them carefully.
1. What a Membership Is
A Membership is a one-time purchase that grants you access to a fan community and a set of member benefits associated with the recording artist Nic Dean. Memberships are offered in tiers (currently "Standard" and "Premium"), each with its own benefits as described on the Site at the time of purchase.
A Membership is a digital access product. It is not a security, an investment, a financial instrument, a share of any business, or a promise of any financial return. You are purchasing access and benefits for your personal enjoyment as a fan. You should not purchase a Membership with any expectation of profit.
2. Eligibility
You must be at least the age of majority in your jurisdiction (or have the consent of a parent or guardian) to purchase a Membership. By purchasing, you confirm that the payment information you provide is your own and accurate.
3. Membership Benefits
Member benefits are described on the Site and may include access to a members-only community, early access to releases, exclusive content, voting on certain creative decisions, and other perks that vary by tier.
Benefits are offered on a best-efforts basis and may evolve over time. Some benefits depend on future events that are not guaranteed to occur (for example, concert ticket access depends on a tour taking place). We will make reasonable efforts to deliver the benefits described, but we do not guarantee the timing, availability, or specific form of any benefit, and benefits may be substituted, modified, or discontinued where reasonably necessary.
4. Beta Notice
The Site is currently offered as a live beta. This means you may encounter bugs, interruptions, or errors. We are actively improving the experience and appreciate your patience as an early member. If you experience an issue, please contact us at nicdeanmusicc@gmail.com and we will work to resolve it promptly.
5. Pricing and Payment
Membership prices are shown on the Site in U.S. dollars and are charged as a one-time payment at checkout. Payments are processed by our third-party payment processor (Stripe). We do not store your full payment card details. Applicable taxes, if any, may be added at checkout.
Memberships are released in limited quantities and in stages. Once a stage sells out, the next stage may be offered at a higher price. The number available and the price for each stage are determined at our discretion.
6. Refund Policy
You may request a full refund within 24 hours of your purchase for any reason, with no questions asked. To request a refund, email nicdeanmusicc@gmail.com from the email address used for purchase. After 24 hours, all sales are final and non-refundable, except where a refund is required by applicable law. When a refund is issued, your Membership and associated access will be revoked.
Refunds are available for members in good standing. We reserve the right to decline a refund where there is evidence of abuse, such as bulk capture or copying of member content.
7. Resale and Transfer
A secondary marketplace where Memberships may be resold or transferred between members may be made available in the future through a separate platform. Any such future resale feature is not guaranteed, may be subject to its own terms, and is not part of what you are purchasing today. We make no promise regarding the existence, timing, terms, or value of any future resale market. You should not purchase a Membership in reliance on the ability to resell it or on any expected resale value.
8. Acceptable Use
You agree not to misuse the Site or community, including by harassing other members, sharing access credentials, attempting to gain unauthorized access, infringing intellectual property, or engaging in unlawful conduct. We may suspend or revoke a Membership, without refund, for violations of these Terms or for conduct that harms the community or other members.
9. Content and Intellectual Property
All content made available through the Membership — including audio, video, images, and written material — is owned by or licensed to us and is provided for your personal, non-commercial use only. You may not copy, redistribute, sell, publicly perform, or otherwise exploit any content without our prior written permission.
10. Disclaimers
The Site, the Membership, and all benefits are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to a Membership or the Site will not exceed the amount you paid for your Membership. We will not be liable for any indirect, incidental, special, or consequential damages.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on the Site with an updated "Last updated" date. Your continued use of the Membership after changes take effect constitutes acceptance of the updated Terms.
